An Ohio judge has dismissed a felony assault charge against former Bengals LB Odell Thurman.

Thurman was accused of punching and shattering a man's jaw at a water park last year, but claimed it was a case of mistaken identity. Thurman, still only 25, remains on indefinite suspension by the NFL. He last played in 2005.

Thurman, who is currently serving an indefinite suspension from the NFL, allegedly punched a man in the face and broke his jaw at Kalahari Waterpark on May 27. Police say the two were arguing about a place in line. Thurman, 25, won't be getting another shot in the league anytime soon.

Thurman, who was reinstated from suspension in April, didn't show for OTAs after the death of his grandmother. If the reasoning for his release is correct, the Bengals are violating NFL rules because the workouts aren't mandatory. It remains to be seen if the weak Players' Union will take action. The Bengals are also left without a true middle linebacker. Thurman has his demons, but figures to be claimed because of his talent. He's also inexpensive.

Bengals beat writer Chuck Ludwig guesses that Odell Thurman, Keith Rivers, and Darryl Blackstock will be the team's starting linebackers this year.

Thurman would play MIKE with Rivers on the weak side and Blackstock at strong side. Blackstock has to hold off Rashad Jeanty and Ahmad Brooks, but may be the best pass rusher of the group. Thurman has big IDP upside.

Thurman was originally suspended for the '06 season after violating the league's substance abuse policy. He violated his probation last year and had a year tacked on. Thurman was one of the NFL's most promising young linebackers as a rookie in 2005. If he hasn't lost his edge, he could compete to start in the middle with Ahmad Brooks or at WLB with Dhani Jones.

Brown says that's when the NFL informed him they'd make their decision. Thurman is already participating in the team's offseason program and should be in good shape as he battles Dhani Jones and Ahmad Brooks for playing time.

Goodell expects to make a decision on whether to reinstate Thurman before the start of training camp. As long as he keeps his nose clean between now and July, Thurman should be an active member of the Bengals this season.

Don't give yourself too much time, Roger. Thurman has sat out the past two years on suspension. "He's in the program. He can make progress," Goodell said. "If he can do that, we will make a decision prior to training camp."
