The Santa Clara county District Attorney's office has decided not to charge Ray McDonald in his domestic violence case.
The DA's office is citing insufficient evidence. It means the 49ers can now claim they are justified for refusing to discipline McDonald in any way even though he was arrested on felony charges for an incident with his pregnant fiancee in August. However, his fiancee reportedly had visible injuries and called 911. "Injuries consistent with restraint and ensuing scuffle rather than an attack," the DA said. The Santa Clara District Attorney's Office is expected to make a formal announcement soon. McDonald allegedly roughed up his pregnant fiancee back in August. He's been playing ever since, with the 49ers letting the case play out instead of suspending McDonald from within. He's started all seven games.

"(There's) due process," GM Trent Baalke said Tuesday. "We're still in fact-finding mode trying to get as much information as we can. We'll have more knowledge today and certainly more knowledge the next day, moving forward. Nothing's been determined at this point." Baalke also claimed the team would handle McDonald's discipline, not the NFL. The CBA dictates that the league handles discipline in cases like McDonald's. Much like they did with Aldon Smith last season, it sounds like the 49ers are going to let McDonald play Sunday.

49ers DE Ray McDonald was arrested on felony domestic violence charges at 5:30am Sunday morning.

Sources tell NBC Bay Area's Damian Trujillo that McDonald's alleged victim was pregnant. He was officially booked for "inflicting injury on a spouse or cohabitant." San Jose police are reportedly saying that there were other 49ers players present at the time of the incident. Note that Roger Goodell just finished apologizing to owners about how he handled the Ray Rice situation, and promised to enforce a more stringent set of rules for domestic violence that includes a six-game ban for first offenders. McDonald, who also got a DUI in 2010, has started 45 games over the last three seasons.

McDonald would have counted $5.34 million against the 49ers' 2014 cap, but his restructuring will decrease that number. The Niners now have more cap space for the possible extensions of Michael Crabtree, G Mike Iupati and holdout OG Alex Boone.

McDonald tore his biceps in Week 5 but played through it and ended up starting 14 games, racking up 37 tackles and 3.5 sacks. He graded out as Pro Football Focus' No. 22 3-4 end out of 45 qualifiers. McDonald was particularly strong against the run. He's under contract for $3.5 million in 2014.

49ers LE Ray McDonald was arrested Wednesday for an outstanding warrant stemming from his 2010 arrest for suspicion of DUI.

McDonald was pulled over for a traffic violation at 2AM Tuesday night/Wednesday morning. Police learned of McDonald's old warrant upon inspection of his record, and released him from jail at 7AM. McDonald is the second 49er to be arrested in the last 12 days, joining OLB/DE Aldon Smith. A high-impact and underrated defender, McDonald had 2.5 sacks in San Francisco's NFC title game loss to the Giants after racking up 5.5 in the regular season.

49ers LE Ray McDonald (hamstring) played just 44-of-80 snaps in Saturday's win over the Saints.

McDonald normally plays just about every down, but he was hobbled by his latest hamstring strain. Backup Ricky Jean-Francois saw 36 snaps. McDonald was one of the best 3-4 defensive ends in football this season.
